Hearings and Appeals

Overview

Registered participants or members have the right to appeal to Hockey Manitoba regarding disputes, differences or questions arising from decisions made by Hockey Manitoba or any member group where the regulation or policy under which such decision was made grants such a right to appeal.

As of May 2, 2026 Hockey Manitoba have adopted an updated appeal policy as a part of the Safe Sport Policy Manual implemented by Sport Manitoba as a part of the Protecting Youth in Sport Act. This new appeal policy outlines the grounds under which an appeal will be accepted by the branch as well as the applicable areas that are/are not eligible for appeal.

Appeal Submission Procedure

Participants or members who wish to Appeal a decision have seven (7) days from the date on which they received notice of the decision to submit, in writing to Hockey Manitoba or the ITP (in the case of maltreatment decisions). Appeal submission must include the following:

  1. Notice of the intention to Appeal
  2. Contact information and status of the Appellant
  3. Name of the original decision maker(s) and any Affected Parties, when known to the Appellant
  4. Date the Appellant was advised of the decision being appealed
  5. A copy of the Decision Report being appealed, or description of decision if written document is not available
  6. Grounds for the Appeal
  7. Detailed reasons for the Appeal
  8. All evidence that supports these grounds
  9. Requested Remedy or remedies.

A participant or member who wishes to imitative an Appeal beyond the seven (7) day period must provide a written request stating the reasons for the exemption. The decision to allow, or not allow an Appeal outside of the seven (7) day period will be at the sole discretion of Hockey Manitoba.

All Appeal submissions must be submitted to dstewart@hockeymanitoba.ca.

Appeal submissions will be reviewed by the Hockey Manitoba Manager, Operations and the Chair of the Hearings and Appeals Committee to determine whether or not they are eligible to move forward for hearing.

Appeal Hearings

All appeal hearings will be done by the Hockey Manitoba Hearings and Appeals committee. This committee shall consist of 6 individuals appointed by the Hockey Manitoba Board of Directors in cooperation with the Hockey Manitoba CEO.

All hearings will be held within a timeline determined by the Chair of the Hearings and Appeals Committee and are subject to availability of committee members.

Appeal hearings will take place virtually and will consist of review of documentary evidence submitted to the committee in advance of the hearing date. Appellants, Respondents and Affected Parties will not be permitted to attend the virtual appeal hearing unless requested to do so by the Committee.

Decisions

The Committee shall issue its decision, in writing and with reasons, within fourteen (14) days after the conclusion of the hearing. The Committee may decide to:

  1. Reject the Appeal and confirm the decision being appealed.
  2. Uphold the Appeal and refer the matter back to the initial decision-maker for a new decision.
  3. Uphold the appeal and vary the decision.
